CONTRACT FOR BOUDOIR PHOTOGRAPHY SERVICES

The following are the terms and conditions of this contract.

TERMS & CONDITIONS | AGE OF CONSENT: You must be 18 years or older to be eligible for Boudoir Photography Services. All clients are required to provide valid government-issued identification at the time of booking to verify their age. If any false information is provided regarding age, Bad Kitty Photography reserves the right to cancel the session without refund.

GROUPON SESSIONS ONLY: Your session fee covers your photo session and venue rental only. It does not include viewing deposits, advanced editing, prints, digital images, or book packages. These are all separate fees that must be paid in addition to the session fee. A viewing deposit must be paid in full before images are released.

GLAMOUR SERVICES (BYOB): Your session does NOT include hair or make-up services. These services can be added for an additional fee, paid at the time of booking.

EDIT LEVELS: Advanced retouching services are available at an additional cost, which includes skin smoothing, blemish removal, and other detailed enhancements. 

PRINTS, DIGITAL, AND BOOK PACKAGES (BYOB): Your session does NOT include images of any kind, in any format. These must be purchased separately in addition to your session fee.

OUR PRICING: You acknowledge that you have reviewed our pricing, posted publicly on our website. Prices are non-negotiable.

HOTELS & VENUES: All sessions are held in rented Airbnbs, production studios, commercial venues, or hotel rooms, as per our preference, and may vary for each session. You will receive the address of the venue a few days before your session.

TIMELINESS: Please arrive on time, as you will not be the only appointment. If you are late, your session may be cut short or canceled to avoid inconveniencing the next client. If you are more than 15 minutes late and have NOT contacted your photographer directly, we will assume you are not coming, and your session will be canceled. You will still be liable for all venue expenses paid. No refunds will be provided for cancellations due to tardiness.

FRIENDS: We prefer to have a 1-on-1 photoshoot with you, as we believe other people in attendance quite often negatively impacts your ability to relax and engage. However, if you want to bring someone, their energy should be positive, fun and must not interject or influence the your boundaries or choices.  If their presence affects your mood or brings down the energy of the shoot, they will be asked to leave.  Friends may NOT take pictures or record video during the session without permission. If they do, you will BOTH be asked to leave with no refunds given. Biologically female friend only, No exceptions.

PARTNERS (WIVES & HUSBANDS): Partners will not be allowed to attend the shoot. We find that their presence often distracts clients and impacts the shoot's quality. Partners can drop you off, say hello, but they must leave afterward—NO EXCEPTIONS.

PRIVACY: Bad Kitty Photography will not sell, rent, or otherwise distribute your personal information, images, or likeness to any third party without your express written permission. A signed model release is required for the use of any images.

LIMIT OF LIABILITY: Bad Kitty Photography will make every effort to provide high-quality photography services. We give the utmost respect to the exposure, transportation, and processing of photographs using professional equipment and backup systems.

In the unlikely event that your photographs are lost, stolen, or destroyed beyond our control, our liability is limited to returning all payments made. The limit of liability for partial loss of digital media or originals shall be a prorated amount based on the total number of originals.

PHOTO EDITING: Bad Kitty Photography will deliver photos edited to the best of our ability. Once the final product has been delivered, there are no further obligations for additional image manipulation or changes.

WARDROBE AND STYLING: The client is responsible for providing all wardrobe, shoes, and jewelry for the photoshoot. Additionally, the client should provide examples of makeup and hairstyles they would like to achieve. No reshoots or refunds will be provided if the client is dissatisfied with their wardrobe or styling.

CANCELLATION & RESCHEDULING POLICY: We have a STRICT cancellation and rescheduling policy. 30 days notice MANDATORY. So not committing to a date that you cannot honor.

• Cancellation: If you cancel ALL deposits paid will be forfeited. No refunds will be issued. If we have already purchased flights, venues, or other services, you will be liable for reimbursing all non-refundable costs incurred. These costs will be charged to the card used for your session deposit.

• Rescheduling: There is a $250 rescheduling fee. If we have already booked venues, flights, or services, you will be responsible for any additional costs incurred. These costs will be charged to the card used for your session deposit.

Please select a session date that works with your schedule and personal circumstances, including menstruation cycles.

SICKNESS/COMMON COLD/COVID/FLU POLICY:

• If we have NOT yet purchased flights and venues, we can reschedule your session for a minimum of 30 days later with zero rescheduling fees.
  
  
• However, if we HAVE already purchased flights or booked venues, you are responsible for reimbursing these direct costs. We will provide receipts and proof of the costs, and once reimbursed, your session will be rescheduled for a minimum of 30 days later with zero rescheduling fees.

SAME DAY NO SHOW: If you fail to show up for your scheduled and confirmed appointment, Bad Kitty Photography reserves the right to charge your card a non-refundable penalty of $500 for Ala Carte Sessions, $1000 for All Inclusive Sessions and $1750 for Experience Sessions. NO EXCEPTIONS.

By signing below, I acknowledge that I have read, understood, and agree to the terms and conditions stated in this contract, including all cancellation, rescheduling, and liability policies.
